These Digital Gift Card Terms (“Terms”) govern the purchase and use of digital gift cards issued by Kalle Halle GmbH, Karl-Marx-Straße 101, 12043 Berlin, Germany (“Kalle Halle”).
1.1. Kalle Halle issues digital gift cards in electronic form (“Gift Cards”) for purchase via its online sales channels.
1.2. These Terms apply to all purchases and redemptions of Gift Cards, unless expressly agreed otherwise in writing, or unless separate terms are agreed for corporate, business, or bulk purchases.
1.3. Gift Cards may be redeemed only with Kalle Halle’s permanent participating vendors and only for eligible food and beverage purchases. A current overview of participating vendors is available at https://kallehalle.com/eat-and-drink/. For details on exclusions, see Section 6.1.
1.4. Kalle Halle acts as issuer and administrator of the Gift Card programme. Unless expressly stated otherwise at the relevant point of sale, goods purchased upon redemption are supplied by the respective participating vendor.
2.1. Gift Cards may be purchased through Kalle Halle’s online sales channels.
2.2. For online purchases, the customer submits a binding offer to purchase a Gift Card by completing the online checkout process.
2.3. For online purchase, the contract is concluded upon acceptance by Kalle Halle, which occurs upon transmission of an order confirmation and/or electronic delivery of the Gift Card following successful payment.
2.4. The customer is responsible for ensuring that all information submitted during the order process, including the recipient’s email address where applicable, is accurate and complete.
2.5. For corporate gifting, business purchases, or bulk orders, Kalle Halle may offer separate commercial terms. Enquiries should be directed to market@kallehalle.com. Where separate terms are agreed with Kalle Halle, they shall prevail over these Terms to the extent of any inconsistency.
3.1. For online purchases, Gift Cards are delivered electronically to the email address provided at checkout.
3.2. Electronic delivery takes place following successful payment processing.
3.3. If a Gift Card delivered electronically is not received within a reasonable period after payment, the customer should notify Kalle Halle without undue delay.
4.1. A Gift Card is a stored-value voucher redeemable, in whole or in part, solely for eligible food and beverage purchases from Kalle Halle’s permanent participating vendors, subject to these Terms.
4.2. The purchase of a Gift Card does not constitute the purchase of specific goods or services at the time of issue.
4.3. The goods and services available upon redemption, and any taxes applicable to them, are determined by the actual transaction concluded at the time of redemption.
4.4. A Gift Card does not constitute a bank account, payment account, electronic money product, or other regulated financial instrument.
4.5. Gift Cards are issued at a fixed value and are not reloadable. No additional value may be added after issue.
4.6. The Gift Card balance is separate from, and not linked to, any loyalty points, credits, rewards, or promotional balances operated by Kalle Halle or any participating vendor. Unless expressly stated otherwise, Gift Card value cannot be converted into loyalty points or credits, and vice versa.
5.1. Gift Cards may only be redeemed with participating vendors at Kalle Halle and only through the redemption process designated by Kalle Halle.
5.2. Redemption is possible up to the available balance.
5.3. If the purchase price exceeds the available Gift Card balance, the difference shall be paid using another payment method accepted by the relevant vendor.
5.4. Unless expressly stated otherwise, Gift Cards may not be used for the purchase of additional gift cards.
5.5. Gift Cards are not reloadable unless expressly designated as reloadable by Kalle Halle.
5.6. Gift Cards may only be used for eligible food and beverage purchases from Kalle Halle’s permanent participating vendors. They may not be used with temporary vendors or for pop-ups, fairs, markets, special events, ticketed events, masterclasses, workshops, merchandise, or other goods and services outside the ordinary food and beverage offering, unless Kalle Halle expressly provides otherwise in a specific case. Any such exceptions will be communicated separately. Kalle Halle may add vendors or categories eligible for redemption at any time.
5.7. Only one Gift Card may be used per payment. Where the Gift Card value exceeds the purchase amount, the remaining balance stays available for future eligible purchases until the Gift Card expires
5.8.Gift Card value may only be redeemed in accordance with these Terms. It may not be topped up, transferred to another Gift Card, combined with any loyalty account balance, or otherwise treated as a stored account balance, unless Kalle Halle expressly provides otherwise.
6.1. Gift Cards may be redeemed only with vendors participating in the Kalle Halle Gift Card programme at the relevant time. Participation is limited to Kalle Halle’s permanent vendors. Temporary and pop-up vendors are excluded unless Kalle Halle expressly states otherwise. A current list of participating vendors is available at www.kallehalle.com/eat-and-drink
6.2. Kalle Halle may add vendors or categories eligible for redemption.
6.3. The composition of participating vendors may change for operational, contractual, or legal reasons.
6.4. Kalle Halle will update the relevant vendor information within a reasonable time following any change.
6.5. A change in the participation of an individual vendor does not affect the remaining balance of a valid Gift Card, provided redemption remains possible with other participating vendors.
7.1. Unless a longer validity period is stated at the time of issue, Gift Cards remain valid until 31 December of the third calendar year following the year of purchase. For example, a Gift Card purchased on 15 June 2026 remains valid until 31 December 2029.
7.2. Due to technical limitations of the Gift Card system, the expiry date initially displayed in the customer account, wallet, email, or system interface may be calculated as three (3) years from the date of purchase. Where this displayed date differs from the validity period stated in Clause 7.1, the validity period in Clause 7.1 shall apply.
7.3. Kalle Halle may update or correct the displayed expiry date in the Gift Card system, including by periodic or annual bulk update, in order to reflect the applicable validity period under Clause 7.1.
7.4. Upon expiry, the Gift Card may no longer be redeemed.
8.1. Any unused balance remains available until the Gift Card expires.
8.2. Gift Cards may not be redeemed for cash, and no cash change will be given, except where required by mandatory law.
8.3. Information about the remaining Gift Card balance is available through the channels designated by Kalle Halle.
9.1. Gift Cards may be transferred to third parties for private use.
9.2. Gift Cards may not be resold commercially, used for unauthorised promotional activities, or otherwise commercially exploited without the prior written consent of Kalle Halle.
9.3. Kalle Halle reserves the right to refuse redemption where there are reasonable grounds to suspect fraud, misuse, unlawful conduct, or unauthorised commercial use.
10.1. The customer is responsible for keeping the Gift Card code secure against loss, theft, unauthorised access, and misuse.
10.2. Any person presenting the valid Gift Card code may redeem the Gift Card. Kalle Halle is not liable for redemption by an unauthorised person unless such redemption is attributable to a fault in Kalle Halle’s systems or another circumstance for which Kalle Halle is legally responsible.
10.3. If a Gift Card is lost, stolen, deleted, or accessed without authorisation before redemption, the customer should notify Kalle Halle without undue delay. Where technically feasible and where the Gift Card has not yet been redeemed, Kalle Halle may, at its discretion, investigate and assist with blocking or reissuing the Gift Card.
11.1. Kalle Halle may temporarily suspend the issuance or redemption of Gift Cards where reasonably necessary for technical, security, fraud-prevention, or legal compliance reasons.
11.2. Kalle Halle shall use reasonable efforts to restore normal operation without undue delay.
11.3. If a Gift Card cannot be redeemed due to a technical issue within the Kalle Halle Gift Card system, the customer should contact Kalle Halle for assistance.
12.1. Consumers who purchase a Gift Card online may be entitled to a statutory right of withdrawal. This Clause 12 does not apply to business or corporate purchases unless mandatory law provides otherwise.
12.2. Unless a statutory exception applies, the withdrawal period is fourteen (14) days from the date of conclusion of the contract.
12.3. To exercise the right of withdrawal, the customer must notify Kalle Halle by means of a clear declaration before the withdrawal period expires. For this purpose, the customer should complete and submit the Model Withdrawal Form attached as Annex 1, or otherwise provide equivalent information sufficient for Kalle Halle to identify the purchase and process the withdrawal request.
12.4. Upon receipt of a valid withdrawal request, including the required purchase details, Kalle Halle will review the request and, where applicable, reimburse payments received from the customer in accordance with applicable law and, unless otherwise agreed, using the same payment method as the original transaction.
12.5. If a Gift Card has already been fully or partly used within the withdrawal period, the handling of any withdrawal request or reimbursement may depend on how much of the Gift Card has already been used and on the applicable legal rules.
13.1. Except where mandatory law provides otherwise, Gift Cards are non-refundable after the statutory withdrawal period has expired.
13.2. Mandatory rights of the customer in cases of duplicate payment, technical error, or other circumstances requiring reimbursement by law shall remain unaffected.
14.1. Upon redemption of a Gift Card for food or beverages, supplied by a participating vendor, the contract is concluded with the relevant vendor, unless expressly stated otherwise at the point of sale.
14.2. Questions, complaints, or claims relating to the quality, composition, allergens, preparation, availability, or performance of goods or services should be directed to the participating vendor supplying them.
14.3. Questions relating to the purchase, issue, delivery, balance, technical redemption, or withdrawal of a Gift Card should be directed to Kalle Halle.
15.1. Kalle Halle is liable without limitation in cases of intent, gross negligence, injury to life, body, or health, and in all other cases where liability cannot be excluded under mandatory law.
15.2. In cases of slight negligence, Kalle Halle’s liability is limited to breaches of material contractual obligations and to damage that was typical and foreseeable at the time of conclusion of the contract.
15.3. Mandatory statutory rights of consumers shall remain unaffected.
15.4. The liability of any participating vendor for goods or services supplied by that vendor remains unaffected.

17.1. These Terms are governed by the laws of the Federal Republic of Germany.
17.2. Where the customer is a consumer habitually resident in another country, this choice of law does not deprive the customer of the protection afforded by mandatory provisions of the law of that country.
17.3. Mandatory statutory provisions on jurisdiction remain unaffected.
18.1. Kalle Halle is not obliged to participate in dispute resolution proceedings before a consumer arbitration board and does not voluntarily do so.
